Disclosures need supporting evidence

Ontario mortgage brokerages must provide borrowers with prescribed disclosures — including Form 1 under O. Reg. 188/08. The signed form is not the whole file.

FSRA supervision expects documentation that supports what was disclosed: income used in qualifying, employment status, property value basis, and credit information relied upon.

When supporting documents live in email threads, the disclosure record and the evidence record diverge.

Common support documents

A defensible borrower file typically includes evidence for:

  • Identity — government photo ID per brokerage policy
  • Income — pay stubs, employment letter, T1/NOA for self-employed
  • Employment — letter confirming role and tenure
  • Property — APS, appraisal or valuation support where applicable
  • Down payment — bank statements, gift letter with donor proof
  • Credit — consent record and documentation relied upon
