Claims correspondence retention for Ontario personal-lines brokers

Claims correspondence retention for Ontario personal-lines brokers

Adjuster sends settlement letter. CSR saves to inbox. CSR leaves. Letter gone. Client disputes three years later.

Direct answer

Treat claims intake as checklist + export to BMS — FNOL form, photos, police report, adjuster letters as labelled lines. Hivi-X can support FNOL document collection; retention policy and legal duties stay firm-wide.

Retention framing (confirm with counsel)

Under R.R.O. 1990, Reg. 991, s. 17, required records may be electronic or paper if they remain accurate, intelligible, and producible within a reasonable time. Required records must generally be preserved for at least the six-year period previous to the member's most recent fiscal year-end. RIBO materials also note that files may need to be kept longer for contractual, privacy, limitation-period, or E&O reasons — especially where claims remain unresolved.

There is no separate “claims correspondence statute” inventing a different clock in this article. Material claims emails, adjuster PDFs, and broker advice notes belong in the same client file you would produce on spot check or complaint — not in personal mailboxes.

What this looks like in practice

A GTA personal-lines client reports water damage Sunday night. The producer logs advice in a quick email; photos arrive Monday by text; the adjuster sends a coverage letter Wednesday to the CSR. Without checklist lines, only the FNOL note lands in the BMS — the adjuster PDF stays in the CSR inbox until someone asks during a complaint review. One export habit prevents that gap.

Tool fit

High FNOL volume brokerage? Checklist beats inbox. Two claims a month with solid BMS email save discipline? Dedicated intake software may be optional — the retention duty is not.

Ontario bottom line

RIBO-facing retention is not "we can probably find it." When a client alleges advice given at FNOL, the adjuster letter and your written record need to live in the same client file — not in a departed CSR's Outlook archive. Export early; audit late. Treat adjuster PDFs like bind documents — checklist line, approve, export to BMS.

Frequently asked questions

What claims correspondence should brokers retain?
Typically FNOL record, client communications, broker advice documentation, insurer/adjuster letters, coverage decisions, and related policy documents — follow current RIBO retention guidance and firm policy.
How long retain personal-lines claims files?
Reg. 991 s. 17(9) generally requires required records to be preserved for at least the six-year period previous to the most recent fiscal year-end. Longer periods may be needed for limitation, E&O, or contractual reasons — confirm with counsel.
Should FNOL photos go on a checklist?
Yes — damage photos, police reports, and third-party info as separate lines improve completeness and retrievability.
Does Hivi-X sync with insurer claim portals?
No. Export the broker-side file; insurer portals remain separate.
When is email filing enough?
Only if material correspondence is consistently saved into the designated client file/BMS — inbox-only habits fail when staff leave.
