Do not tell staff that "the abstract shows claims." Some abstracts include accident notations; many do not list insurer-paid claims the way AutoPlus does. Follow the MGA's required reports.

Micro-steps when loss history exposes a claim

  1. Do not bind on a known mismatch — that is operational risk management, not a statutory "bind timer."
  2. Note the entry on the file (date, type, source).
  3. Reject the application line — "Undeclared loss YYYY-MM — amend and re-sign."
  4. Re-quote if the premium changes — log mandatory disclosures per RIBO disclosures at quote.
  5. Approve lines only when sources align, then bind in the BMS.

Ontario's Insurance Act s. 233(1) says that if an applicant knowingly misrepresents or fails to disclose a fact the application requires, a claim by the insured may be invalid and indemnity forfeited — with statutory accident benefits treated separately under s. 233(2). Statements used in defence of a claim generally must appear in the signed written application (s. 233(3)). That is a reason to keep a clean signed app on file — not a script for brokers to declare a policy void. Confirm with compliance counsel.
