Move-in activation is a possession gate

January 1 lease move-in activation is the document checkpoint before tenants receive keys — common in Ontario when leases align to calendar year or post-holiday relocation.

Realtors and property managers should not activate possession on verbal promise when the executed lease, lawful rent deposit, inspection record, or insurance proof (if required) is still missing.

Under the Residential Tenancies Act, landlords of most covered units may collect a rent deposit applied to the last rental period (capped at one month's rent or one rental period, whichever is less) and a refundable key deposit. Damage deposits are not a lawful substitute. If a tenant asks for a receipt for rent or a deposit, the landlord must provide one free of charge.

Is a move-in inspection legally mandatory?
Ontario's Residential Tenancies Act does not generally require a statutory move-in condition report the way some other provinces do. Documenting baseline condition is still strong operational practice for later disputes — confirm with landlord counsel.
What deposit is allowed?
For most covered tenancies, landlords may collect a rent deposit for the last rental period (not a damage deposit), plus a refundable key deposit limited to replacement cost. Receipts must be provided free on request.
