What the College's rules actually require

Two anchors worth knowing (confirm current versions with the College):

  • The Code of Professional Conduct (SOR/2022-128) requires licensees to maintain a reliable system of office administration and to keep and preserve records. College guidance on that section emphasizes recording actions and communications in the client file promptly — date, time, action/outcome, and follow-up.
  • The Client File Management Regulation requires opening a client file at retainer; maintaining accurate, up-to-date client records; employing a clear and coherent system to open, label, store, retrieve, close, retain, and destroy files; including supporting documents and copies of correspondence between/about the client and the licensee; storing files securely; and retaining closed files for at least six years after closure, with destruction documented.

A request-vs-received trail is how those obligations look in practice. Channel specifics (email, text, messaging apps) are not a substitute for a complete file — if substantive instructions or documents arrive out of band, copy them into the named client record rather than leaving them on a phone.
