Spousal open work permit document intake for RCICs
Spousal open work permit document intake for RCICs
Spousal open work permit (SOWP) files fail when the practice uses a generic work-permit list and never asks for the marriage certificate.
Direct answer
Build a SOWP-specific Hivi-X checklist: applicant identity, relationship evidence, and proof of the spouse or partner's qualifying status under current IRCC rules. Eligibility has changed in recent years — verify on canada.ca before you collect. Hivi-X does not determine who qualifies.
Two document stacks
| Stack | Examples (confirm live IRCC SOWP rules) |
|---|---|
| Relationship | Marriage certificate; or IMM 5409 + cohabitation evidence |
| Status of partner in Canada | Study permit, work permit, PR / COPR, or other category IRCC currently accepts as the anchor |
| Applicant | Passport, photos, previous permits, biometrics fee receipt if already paid |
Do not import LMIA, wage, and employer-compliance lines from work permit intake unless the file is actually employer-specific.
Rules move; checklists must be versioned
IRCC has repeatedly retargeted who may obtain a spousal open work permit (study level, occupation, duration). Your 2024 template can be wrong in 2026. Operational habit:
- Read the live IRCC page when the retainer is signed
- Clone the Hivi-X template and delete lines that no longer apply
- Add any new proof IRCC now lists
Hivi-X does not update legal rules for you.
Inland vs overseas collection
Overseas applicants need guest link. The in-Canada partner often holds the status PDFs — they can upload those lines from Ontario on the same file.
Related: spousal sponsorship, common-law evidence, study permit.

Frequently asked questions
- What documents do RCICs collect for a spousal open work permit?
- Typically the applicant's passport and photos, relationship evidence (marriage certificate or common-law package), and proof of the spouse or partner's qualifying status (study, work, or PR pathway — whatever current IRCC SOWP rules require). Confirm the live IRCC instruction.
- Can I reuse my LMIA work-permit checklist?
- No. SOWP files are relationship-and-status files, not employer-LMIA files. Separate templates prevent collecting a job offer you do not need and missing IMM 5409 you do.
- Do inland and overseas SOWP use the same template?
- Core relationship lines overlap; status documents and forms differ. Use optional lines or two templates rather than one ambiguous list.
- Does Hivi-X check if the couple qualifies for SOWP?
- No. IRCC has tightened and retargeted open work permits. You interpret current eligibility; Hivi-X tracks documents.
- How do overseas spouses upload?
- Secure guest link with email OTP, same as other overseas intake.
