On a Tuesday, a former client emailed a Regent Park immigration boutique: "Please send all personal information you have about me under PIPEDA." The managing RCIC agreed — then spent two days finding passport scans in three staff inboxes, a Google Drive folder shared with a typo, and WhatsApp media auto-deleted on a clerk's phone.

The next access request took hours, not days, because intake already lived on one exportable record.

What an access request typically covers

Under PIPEDA's individual-access principle, people may generally ask you to:

  • Confirm what personal information you hold about them
  • Explain where it was obtained
  • Explain how it is or has been used and to whom it has been disclosed
  • Obtain access (for example a copy or viewing), at minimal or no cost, subject to limited exceptions
  • Challenge accuracy and seek correction where appropriate

For an RCIC file, that often includes documents the client provided, retained correspondence, and third-party reports you still hold (medicals, police certificates, education letters) — plus notes that identify the individual. If collection was email-first across staff devices, you cannot confidently answer what you hold or when it was collected.

Timing (confirm current law): PIPEDA generally expects a response no later than 30 calendar days after receipt of a written request. Limited extensions (commonly up to another 30 days in specified circumstances, or longer when converting to an alternate format) require notice within the original 30 days, with reasons and notice of the right to complain to the OPC. Silence past the deadline can be treated as a refusal. Identity verification before disclosure is essential.

When the access email arrives:

  1. Log the request date and route it to whoever owns privacy responses.
  2. Verify requester identity before releasing anything.
  3. Pull the client-record export of approved uploads; add CRM notes and list legacy email or Drive folders not yet migrated.
  4. Document uses and disclosures you can reconstruct; note gaps honestly.
  5. Respond within your policy timeline (aligned to the statutory clock); retain the request, production set, and response while any recourse may still be open.

Frequently asked questions

Does PIPEDA require a special portal?
No specific portal is mandated. Organizations must be able to locate and provide personal information they hold about the requester (subject to limited exceptions), typically within 30 days.
What should the file trail include?
Often: documents collected, dates received, collection sources, uses and disclosures you can reconstruct, who approved uploads, and your written response — plus any CRM or email still outside the checklist. Confirm scope with counsel.
Are WhatsApp photos part of the access response?
If you retained them as personal information about the requester, they may form part of what you hold. Better practice: move matter documents into the official client record promptly so inventory is not phone-dependent.
Can Hivi-X export everything for an access request?
