RECO trading record retention for Ontario realtors

RECO trading record retention for Ontario realtors

Agent left the brokerage. Trading records live on a personal Google Drive named "OLD STUFF DO NOT DELETE maybe." Broker of Record owns that problem.

Direct answer

Trading records = brokerage-produced evidence of the deal — trade record sheets, agreements, disclosures, IDs, deposit proof, communications the brokerage is required to keep. Under O. Reg. 579/05 (s. 19) under TRESA, brokerages retain required records for at least six years (unless the registrar specifies otherwise), at the brokerage's main office unless the registrar specifies a different location; unaccepted written offers are kept at least one year (s. 20). RECO guidance frames the six years as running from transaction completion — confirm the current reading with your Broker of Record.

Frequently asked questions

How long must trading records be kept?
Under O. Reg. 579/05 under TRESA, brokerages must retain required documents and records for at least six years, unless the registrar specifies a different period. RECO guidance describes this as six years after the transaction completes. Unaccepted written offers: at least one year. Verify current requirements with your Broker of Record.
Where must records be kept?
The regulation defaults to the brokerage's main office unless the registrar specifies otherwise — brokerage compliance decides how electronic storage fits that. Not something an individual agent's personal drive satisfies.
Does Hivi-X replace brokerage DMS?
No — export PDF to brokerage record system of record.
What should export include?
Approved checklist items: disclosures, IDs, deposit proofs, consents collected through intake — feeding the brokerage file that also holds trade record sheets and agreements.
Personal agent copies?
Brokerage of record owns file — follow office policy on exports.
Automated retention purge?
Not legal advice here — configure per brokerage IT and compliance.
