Facebook Messenger for immigration documents — RCIC risks

Facebook Messenger for immigration documents — RCIC risks

Messenger is social chat, not a client file

Facebook Messenger document collection happens when Ontario RCIC clients — often overseas family members — send passport photos and police certificates through a page inbox because that is where they first contacted the firm.

Convenient for hello. Risky for the immigration client file.

Why RCICs see Messenger uploads

GTA and Brampton practices often acquire clients through:

  • Community Facebook groups
  • Sponsorship referral chains
  • Live Q&A sessions on a business page

The aunt in Punjab sends six photos at 2 a.m. The principal wakes up to a Messenger thread, not a labelled checklist item.

See WhatsApp is not an immigration client file for parallel channel discipline — same principle.

CICC client-file expectations typically include supporting-document copies and correspondence in an organized, confidential file — not a social inbox as the only record. Privacy obligations (often PIPEDA for commercial practices) still apply to how you store and share personal information; this is not a full privacy opinion.

Defensible workflow

  1. Initial contact on Messenger OK — answer general questions (avoid case-specific advice in DMs without a proper retainer/file).
  2. Retainer signed — move to structured intake.
  3. Send checklist link — guest OTP for relatives without accounts; overseas mobile upload QC applies.
  4. Same-day transfer — if the client insists on a Messenger photo, attach to the checklist item immediately and QC there.
  5. Export for CICC records — PDF package from the checklist, not a screenshot folder of the chat.

Never treat Messenger history as your only proof of receipt.

Frequently asked questions

Is Facebook Messenger banned for RCIC client documents?
This article does not invent a Messenger ban. CICC client-file rules typically expect organized supporting documents and correspondence in the client file, with secure storage. Messenger may occur in practice but is weak as a document system of record — confirm your compliance approach with counsel.
What are the main risks?
Commingled personal/social graph, unclear retention and export, no approve/reject trail, screenshots instead of proper scans, and difficulty proving what was received when.
What should RCICs send instead?
One secure checklist link — guest link with email OTP for clients without my-id.ca accounts, when guest access is enabled.
Can staff still chat on Messenger?
Many firms use Messenger for marketing or initial contact — then pivot: 'Upload here for your file.' Document the pivot on the client record.
Does Hivi-X import Messenger threads?
No. If a photo arrives on Messenger, save it to the named checklist item the same day and QC there.
