Parallel obligations

Ontario mortgage brokers operate under two record-keeping frameworks:

FSRA — fraud-prevention policies, identity verification, documentation supporting Form 1 disclosures under the MBLAA and O. Reg. 188/08.

FINTRAC — since October 11, 2024, mortgage brokers are reporting entities with compliance program and client identification record requirements under the PCMLTFA.

These obligations overlap but are not identical. Your brokerage compliance program defines how records are stored and for how long.

How long must mortgage brokers retain client records?
FINTRAC guidance commonly requires 5 years for certain identification and transaction records. FSRA expectations are set by MBLAA, O. Reg. 188/08, and current guidance. Consult your principal broker.
