FSRA broker examination evidence for client files

FSRA broker examination evidence for client files

“FSRA examination evidence” for Ontario brokers usually means files that can survive a RIBO spot check while demonstrating compliance with FSRA-set rules (notably Take-All-Comers and related UDAP expectations for auto). FSRA examines RIBO annually under the Registered Insurance Brokers Act; it does not typically examine each brokerage the way RIBO auditors do under Regulation 991. GTA personal-lines teams that recover quickly from file requests share one habit: every sampled client file tells the same story from first quote through bind.

What reviewers typically expect on file

Record typeOperational expectation (verify current guidance)
Mandatory disclosure at/before quoteWritten proof disclosures reached the client no later than quote time (RIBO Mandatory Disclosures guidance)
TAC quote documentation (auto)Quote log / market summary with premium, market, and broker comments; rationale when lowest rate was not taken (RIBO Guidance 004 themes)
CISRO Principles + RIBO Fact SheetEvidence customers received or could access both documents (required of RIBO licensees since September 1, 2022)
Needs / suitability notesBMS or file notes showing advice and recommendations
Signed application / bind confirmationApplication and confirmation of what was bound
Quote and bind correspondenceChronology of what was communicated and when

RIBO’s published 2023–24 spot-check findings reported that 57% of reviewed brokerages lacked written disclosure documentation in client files, and that some files also missed lowest-quote confirmation notes or CISRO/Fact Sheet copies. Use that as a self-audit prompt — not as a prediction of your next review outcome.

Organize before the request — not during

  1. Sample recent files across auto, home, and renewal — score each against your intake checklist.
  2. Flag missing disclosure records — still among the highest-frequency findings RIBO has published.
  3. Standardize CSR intake so every producer collects the same core evidence lines.
  4. Export PDF packages per client for principal-broker review.
  5. Document remediation for any file that fails your internal audit.

See the RIBO spot check preparation guide for a parallel self-audit workflow, and RIBO mandatory disclosures at time of quote for disclosure timing.

Why scattered email fails file production

Disclosures in one thread, ID in another, application in a third — auditors cannot reconstruct the quote timeline from memory. A checklist on the client record with approve/reject QC creates a single intake trail principals can sample before RIBO asks.

Deploy standardized intake in Hivi-X

Build examination-ready templates for auto new business, home new business, and renewals. Attach per client. Track missing items. Export PDF packages for BMS upload and principal review. Co-agent access lets oversight happen without sitting at each CSR’s desk.

Hivi-X does not send automated client reminder emails, replace your BMS, or certify RIBO/FSRA compliance. It makes each required intake item visible — todo, submitted, approved, rejected — so you can export what your compliance policy already expects you to keep.

Frequently asked questions

Does FSRA examine individual insurance brokers?
Generally no. FSRA does not have direct regulatory oversight of individual RIBO brokers in the same way RIBO does. Under the Registered Insurance Brokers Act, FSRA conducts an annual examination of RIBO's affairs. Brokerage books and records are examined by RIBO (including spot checks under Regulation 991). Brokers remain subject to FSRA rules such as Take-All-Comers and UDAP where they apply.
What do RIBO spot checks commonly look for in personal-lines files?
Written proof of mandatory disclosures no later than quote time, TAC quote documentation (including lowest-rate and rationale notes where relevant), evidence customers could access CISRO Principles and the RIBO Fact Sheet, and coherent BMS/file notes. Confirm current RIBO guidance with your principal broker.
Is the 57% disclosure finding still cited?
RIBO's 2023–24 spot-check findings (61 completed checks) reported that more than half of brokerages (57%) lacked written disclosure documentation in client files. Treat that as a published finding snapshot — verify current RIBO communications for newer results.
How far back should files be organized?
RIBO Guidance 004 (TAC) states consumer files should be retained for a minimum of six years, and longer where contract or privacy obligations require. Principal brokers should confirm current retention expectations for each line of business.
Does Hivi-X replace a BMS?
No. Hivi-X handles document collection and QC. Export completed packages into Applied Epic, Vertafore, Power Broker, or your BMS client folder per brokerage policy.
