Seller disclosure chase before listing goes live

Hamilton listing: Instagram-ready photos posted Tuesday; the buyer-facing disclosure pack signed Thursday. A buyer question on old flooding arrived Thursday night — the listing file had no signed statement and no supporting repair invoice when the question arrived.

Direct answer

Going live on MLS is not the same as a ready disclosure file. Ontario does not legally require a Seller Property Information Statement (SPIS). TRESA still requires the listing agent to take reasonable steps on material facts for the seller client, and — if the agent knows a fact the seller is legally obligated to disclose — to disclose that fact to every interested buyer and make best efforts to get a written acknowledgement.

A checklist is how you stop supporting documents from living in Gmail until offer night. It is not a substitute for those duties.

SPIS vs legal disclosure (do not mix them)

RECO’s consumer guidance distinguishes two uses of a property information statement:

Completing an SPIS is a seller choice (and sometimes brokerage policy). Completing it untruthfully is a different risk — do not treat the form as optional honesty.

Separately, material facts for the seller client are not “whatever is on the SPIS.” RECO’s material-facts guidance (in force with the December 1, 2023 TRESA package) describes four steps: determine, disclose to the client, advise the client to consider the effect, and make best efforts to obtain an acknowledgement. “Reasonable steps” is not met by taking the seller’s verbal story alone — some verification and supporting documents are expected.

Facts a seller must disclose to a buyer (typically latent defects that make the property unfit or dangerous) come from case law, not from TRESA inventing a defect list. If the listing agent knows such a fact, the agent’s disclosure-to-buyers duty is tied to the seller’s legal obligation. Advise the seller to get a legal opinion when the classification is unclear.

Pre-list seller checklist (operations)

Collect what your brokerage and the trade actually need — not a fake statutory SPIS gate:

  • Representation / listing agreement and any brokerage disclosure forms
  • Seller ID and FINTRAC records when your compliance officer says the trade requires them (not the same as SPIS)
  • SPIS or other buyer-facing information statement if the seller is using one — plus a note of the intended use
  • Supporting defect / renovation documents (permits, invoices, prior reports)
  • Rental equipment / tenant occupancy documents if the property is tenanted
  • Condo status path if applicable
  • Written acknowledgements the legislation expects you to try to obtain — filed, not left in a text thread

Listing coordinators can mark ready for media when named lines are approved. That is a team rule, not a RECO listing-live prohibition.

What to change on the next file

One concrete chase, one reusable checklist, one missing-item dashboard. When a document arrives out of band — text, WeChat, walk-in, phone photo — upload it to the matching line the same day. Reject unreadable scans with a short reason. Export a PDF package at the milestone your brokerage expects (listing live, or lawyer send).

Frequently asked questions

Must the seller complete an SPIS before the listing goes live?
No. An SPIS is optional. Brokerage policy may still require one. If the seller completes a written statement intended for buyers, the listing agent must disclose its existence to every interested buyer and provide a copy on request.
What should be on the pre-list checklist if SPIS is skipped?
Typically identity as required for the trade, representation paperwork, and supporting documents that help the agent take reasonable steps on material facts — permits, surveys, leases, known-issue notes. Confirm with your broker of record.
Should photography wait for disclosure docs?
That is an operations choice, not a statute. Many teams gate media until named supporting lines are approved so buyer questions do not arrive before the file does.
Can the seller upload?
Yes. A guest link (email OTP, no account) or portal upload on labelled lines. The agent still reviews and approves or rejects.
