Legal framing (not advice)

Under the Family Law Act, R.S.O. 1990, c. F.3, s. 21 (verify current text), no spouse shall dispose of or encumber an interest in a matrimonial home unless, in summary:

  • the other spouse joins in the instrument or consents to the transaction;
  • the other spouse has released rights under that Part by a separation agreement;
  • a court order has authorized the transaction or released the property from that Part; or
  • a narrow registered designation exception applies.

Transactions done in contravention may be vulnerable to being set aside in the circumstances the Act describes — including good-faith purchaser protections that lawyers, not intake checklists, analyze.

Realtor role: raise the issue early, collect the forms counsel/brokerage use, and keep evidence on the deal file. Lawyer role: decide whether the property is a matrimonial home, what consent or order is required, and whether title can close.
