WhatsApp is not an immigration client file

GTA clients live on WhatsApp. CICC files do not. Treating the chat as the cabinet is how police certificates vanish when a phone is stolen.

Direct answer

Use WhatsApp as a communication channel. Use Hivi-X as the document collection layer. Log chats for CICC; store supporting documents on checklist items. Hivi-X does not ingest WhatsApp.

What CICC actually requires

The Client File Management Regulation expects a file opened at retainer with supporting documents, correspondence, and related records, retained at least six years after closure. Communication in all forms should be recorded.

WhatsApp provides:

  • Fast photos from overseas
  • No per-program missing-item list
  • No approve/reject workflow
  • No Canadian-hosted access control you can explain in a complaint
  • Media that may not survive device changes

That is a channel, not a file.

Practical rule for Ontario practices

  1. Tell clients the guest link is how documents enter the file (email OTP, no account).
  2. If a passport still arrives on WhatsApp, file it onto the passport line the same day.
  3. Reject poor scans on the checklist, not with a voice note that nobody indexes.
  4. Keep a communication log (your CRM or notes). Voice + self-hosted AI summaries on the checklist help consultation recaps — they do not replace chat logging.

Are RCICs allowed to use WhatsApp with clients?
Practices commonly do. CICC still requires you to record communications and keep supporting documents on the client file. The chat thread is not a substitute for either.
Does Hivi-X import WhatsApp automatically?
No. There is no WhatsApp sync. Your team uploads important files onto checklist lines, and you log the conversation in your communication record (CRM, notes, or export).
What if the client refuses a portal?
Guest link only needs email OTP — no my-id.ca account. If they still send files on WhatsApp, you file those uploads onto the correct checklist items the same day so completeness stays true.
Why is a chat dump a bad relationship-evidence package?
Officers and future you cannot QC 10,000 messages. Export selected evidence into labelled checklist items (see the common-law guide).
Does deleting a chat after upload help privacy?
Your CICC and PIPEDA duties are about the file you keep, not wiping the client's phone. Do not destroy records you are required to retain. Ask counsel if you are unsure.
