What the law requires

The Registered Insurance Brokers Act and O. Reg. 991 set minimum record-keeping standards for RIBO members.

Section 17(9) requires members to preserve required records for at least six years preceding the end of their most recent fiscal year — not six years from policy expiry, claim closure, or client departure.

That timing detail trips up brokerages that count from the wrong anchor date.

RIBO handbook guidance

The RIBO Broker Handbook recommends:

  • Six years plus the current fiscal year for customer records
  • Consider 10+ years for commercial lines to manage liability exposure

Your E&O carrier may have expectations beyond the statutory floor. Your Principal Broker should set a written retention policy that meets or exceeds these minimums.

What records must be kept

Required records generally include client files with:

  • Application documents and client identity
  • Written disclosure and suitability documentation
  • Quote records (including TAC quote log evidence for auto)
  • Correspondence and advice notes relevant to the placement
  • Records producible to RIBO on request

Quote-only interactions count — not only bound policies (RIBO FAQ).

Electronic storage requirements

O. Reg. 991 permits records kept by mechanical, electronic, or other device, provided they are:

  • Intelligible — readable without proprietary tools nobody can access
  • Producible — available when RIBO or your Principal Broker requests them
  • Protected — appropriate safeguards for sensitive client information

Loose email attachments, personal phone photos, and unscanned paper binders do not survive a six-year horizon or a production request.

PIPEDA adds a purpose-limitation layer: retain personal information only as long as necessary for the purposes identified — then destroy or anonymize it securely (OPC retention guidance).

Practical storage practices for brokerages

  • Keep client files in a broker-controlled system — not only in insurer portals
  • Use encryption at rest and TLS in transit for electronic records
  • Maintain backup of books and records (Principal Broker duty per RIBO PB Handbook)
  • Export organized packages to your BMS archive when intake completes
  • Document your retention and destruction policy in writing

How long must Ontario insurance brokers keep client records?

Does PIPEDA require seven years of retention?
